Guests acknowledge that outdoor and nature-based experiences involve inherent risks, including but not limited to uneven terrain, weather conditions, insects, wildlife encounters, elevated structures, stairs, walkways, and environmental conditions beyond human control.

By using this Website, making a reservation, or staying at Black Pearl Cove, you voluntarily assume all such inherent risks and agree that Black Pearl Cove is not responsible for injuries, losses, or damages resulting from these natural or environmental conditions, except as required by law.

Indemnification

You agree to indemnify, defend, and hold harmless Black Pearl Cove, its owners, officers, employees, agents, and affiliates from any claims, damages, losses, liabilities, or expenses arising from your use of the Website, violation of these Terms, or violation of any law or third-party rights.

Arbitration

The parties agree that the Federal Arbitration Act governs the interpretation and enforcement of this provision. The entire dispute, including the scope and enforceability of this arbitration provision, shall be determined by the Arbitrator. This arbitration provision shall survive the termination of these Terms and Conditions.

Arbitration & Class Action Waiver

Any dispute arising out of or relating to these Terms or the use of the Website shall be resolved by binding arbitration in accordance with the Federal Arbitration Act. Arbitration shall be conducted on an individual basis. Class actions, collective actions, or representative proceedings are not permitted.
